In addition to the Water Law (of 3 January 1992) applicable to fairing areas, section 6 of the Environment Code and article L 216-6 apply, which states that:
‘The act of discharging, discharging or allowing to flow into surface water, groundwater or seawater within territorial waters, directly or indirectly, any substance or substances whose action or reactions produce, even temporarily, harmful effects on health or damage to flora or fauna, or significant alterations to the normal water supply or restrictions on the use of bathing areas, is punishable by two years’ imprisonment and a fine of €75,000.’
In addition, the Sea Ports Code, through articles R 322-1 and R 353-4 of Book III of the Sea Ports Code (Decree no. 93-726 of 29 March 1993), states:
‘No one may infringe the good condition of ports and harbours in terms of their depth, cleanliness and facilities’. ‘Infringements relating to non-compliance with the areas provided for the disposal of waste and refuse are punishable’.
